Lawsuit for medical mis-diagnosis?

I was in an auto accident on 3/1/07. I was seen in the ER on 3/3/07 & 3/4/07 for my injuries. They claimed my back & neck pain was just from the typical soreness & that my jaw pain (hit in the lower jaw w/ rearview mirror when it came off windhsield) was just a contusion (bruising). According to the chiropractor my back pain & neck pain is from multiple subluxations (shiftment of vertebraes) & a severe case of nerve impengement syndrome. My dentist says I have a hairline fracture of the lower jaw from the mirror hitting me. We have an attorney handling everything & the insurance company is payed off for vehicle & is paying the injuries. My question is this: Can I sue the hospital ER & the 2 doctors that treated me there for their misdiagnosing of my injuries, especially on the jaw when it is fractured & they said it was just a contusion? No treatment done by the dentist for the jaw, as it's stable & only a hairline fracture, so he's letting it heal on its on. I live in Illinois.

personally i think you are a punk if you feel like suing them. THEY did not injure you. THEY tried to help you. in many cases pain and breaks and other injuries are not noticed until a few days after the initial car accident. quit trying to get a quick buck. doctors and nurses work very hard for their clients. its people like you who try to sue them for stupid things that cause THEIR malpractice insurance to increase. your lucky there was a doctor to treat you. keep pulling crap like this and there wont be any doctors left to take care of your poor jaw that is healing on its own.

ps its not like they could do anything for your jaw anyways, and chiropracters will say anything to get you coming back for more treatments.

you could try and an attorney of course can let you know if you reallyhave a case-the thing i see is that the dr's that mis diagnosed are er drs and not specialist etc-the fact is that even though they are dr;s er drs ae just as it says to treat emergency only to stabalize people and so on until they get treated by their own dr or a specialist-er drs are notorious for mis diagnosing-they are not specialist surgeons and so on.
also chiroprator's and medical dr never ever agree -they are 2 totally different "species" l.ol. but really one believes in medicines and the other does not-they always differ in opinions

What did the ER docs mis-diagnose ? The only thing I can see is the hairline fracture which is one of those things that may only show up on an X-ray after the healing process has started and new bone is filling in the crack. The rest of your claim is based upon the opinion of a chiropractor who doesn't posses one quarter nay one tenth of the education and training that an MD does. In a court situation whose opinion do you think is going to be more credible an MD's or a chiropractor's?
Chiropractors often perform what is euphemistically described as a wallet biopsy on their patients. So they have their needs too.

What for? Doctors are doing the best they can, it's not like you got additionally hurt from them not diagnosing a hairline fracture.

I guess it makes me sad that people have your mentality. And I end up paying more for health insurance because of it.
