I want to file one on behalf of my mother's estate.
I am 100% sure I have a case against them. The problem is money. I am forking over so much in probate that I am even coming out of pocket as executor to cover the estate so it makes it through the process. Estate money is tied up within the home.
I have been searching for a lawyer. I got a response back from one but he charges a $ 100 consult fee. Now if I shop around at that price it could get pretty costly.
I really don't want to resort to Ken Nugent so what can I do? I don't want to let these people get away with what they did but being in probate is difficult. I need to get things rolling though at least on one case because statute of limitations will become an issue soon. It was a case my mother was in the process of pursuing before she was too weak and struggling just to stay alive.
What really ticks me off is they want over $ 15,000 for killing my mother.

Keep phoning around. If there is a winnable case, you'll find a lawyer willing to take it on contingency.
Ignore any lawyer who wants a consult fee. Most PI lawyers offer a free initial consult.
There are both advantages and disadvantages to going with a big multi-office practice like Ken Nugent. On the plus side they have the resources to handle big cases - lots of paralegals and researchers, and the money to be able to carry a case for a couple of years with no money coming in.
On the downside, some people feel that they don't get any personal attention from a big firm, and are happier with Joe down the street with his shingle hanging next to the Domino's sign.

Your best bet, if you do not have the resources is to inquire into a large PI firm that will do it on contingency
In general filling a med mal case is not a simple process, in general you will need a doctors statement stating med mal was the case before you can even file, also some states have jurisdiction on notification before suit etc,
Hence most lawyers who do not practice in med mal will even take a case or should take the case, very complex civil lit, much required in discovery , so in your case to get justice you may need to employ a Big PI guy, the firm does not have to be big, the male/female layer needs to have a good rep in the area to get the other side to take the suit as good chance of winning

You must remember that the burden of proof is on you if you sue. You'll have to get a medical professional to say that one of his/her colleagues screw up. It is very hard to prove.
I know you hurt and feel the injustice. Please consider talking to some one to ease your mind.

was it the hospital? they would be the hardest to sue because they have a secret policy and they have been known to fabricate or loose records..This will be very difficult for u unless u find someone probono..u would need a clear cut case for that. Good luck to u
