my sister came home sick from school on october of last year the last week to be exact it was a monday anywho we took her to the hospital that same day because we were afraid it might be the h1n1 and the doctor at kaiser only asked some questions about her symptoms and took a look at her throat and said it was the h1n1 i asked him if he wasnt supposed to do some type of culture to determine that and he said no because it was way more possible to be h1n1 ?? so stupid anywho he said to give her tylenol and i asked him if he would give her some type of antibiotic and he said no tylenol was enough and to keep her well hydrated well my mom woke up sick the next day then me the following day my mom got an appointment at the kaiser clinic on thursday her doctor refused to see her because she had too many patients that day so she was seen by the head nurse or something like that and she just listened to her chest and lungs with the stethoscope and said she had wheezing and her chest was very congested she diagnosed her with bronchitis so she gave her a breathing treatment that lasted 20 minutes then she prescribed her ALBUTEROL a breathing treatment and amoxicillin she said "with this she should get better if she gets worse that's not good" , that was it but they made her wear a mask to cover her mouth and nose.On monday she went to the clinic again now with her doctor but when we got there she seemed kinda agitated her doctor took forever to see her when she finally did the doctor touched my mom she told her that she was extremely cold she decided to do an EKG and sent her to the lab to get some blood work done and some Xrays then they told me to take her to another room because i even had her in a wheelchair because she would get agitated the nurse in there cfhecked her blood pressure and saw that it was very low and called my moms doctor so she came down and told me that they would have to call the paramedics because her blood pressure was extremely low they took her to the nearest hospital then supossedly they would trasport her to the kaiser hospital so i called my dad and sister they were the ones who stayed overnight they told me that they even had to put breathing tube down her throat because she couldnt breathe well later like at 10 am tuesday they went home to shower when my dad went back like at 12:00 am they told him that she had gotten worse that her heart had stopped and that they were trying to revive her my dad was in shock they told that they tried their best but nothing could be done . we waited 3 months to know the real cause of her death they called from the coroners office and they said it was the h1n1 that she suffered a septic shock which caused her blood pressure to drop they said the cause was "death caused due to complications of vital pneumonia " now my question is why didnt the when we first took my sister to the hospital give us specific precautions or something i mean thats what they're trained for something big like the h1n1 not only have i thought we should sue but many people have told us the same thing that we should sue Kaiser Permanente for medical negligence or malpractice because why did the nurse say it was bronchitis when it was the h1h1 she had maybe she could've still have been here :/ ....do you think it's possible we might have a strong case? here we dont want money we just want those doctors their asses fired and get they're license taken away for their stupid error.
well yeah we can sue and yeah the thing would be to find a lawyer for our case and im guessing they have some of the best lawyers there is :/ i just want for them to pay for their error i want those doctors fired that's all we want and hopefully they'll also get something from this and not let this happen again with someone else's family

From what I am reading, maybe. I mean you can sew for practically (or impractically) anything. Whether you would win is the question. It all depends on your lawyer and the doctors lawyer. So YES you can sue.

If the doctor is fired then the clinic is minus one doctor. How many cases like your mum's will there be before they can get another one? What if the next is even less competent? I can understand you're angry but medical care is shit as it is so don't mess it up even more. Plus if she couldn't see your mum because she had too many patients then she probably had a lot on her mind at the time, which means it is unsurprising she didn't immediately add several hours to her workday and a bunch of paperwork besides when it didn't seem necessary. People in hospital die a lot because they aren't tested for things, simply because there isn't enough manpower to test everybody for everything. Doctors do the best they can and it's extremely easy to make a small slip up. Due to the nature of the profession a small slipup can easily result in a death.

On the other hand, if you really feel she wasn't trying at all due to laziness or something, you could. But being a doctor is one of the most stressful careers and it doesn't get anywhere near the thanks it deserves.

Let me tell you something sweetheart, Kaiser Permanente has some damn good attornies!!! I know, cos I was a patient of theirs!!! AND! they DO make mistakes!!! BIG TIME! I would consult a GOOD attorney, and see if you have a viable suit against KP!! I fell down a flight of stairs in the month of August - NOT this year. I was taken to the hospital, given treatment, and told to contact my own doctor. Which I did, and all I got was to have my ankle bandaged!!I couldn't walk, so was wheeled out to my car! I went back a month later, and was still incapacitated! November rolls around, and finally, the doctor decided I should see a Specialist! DUH!!!! They found out, I had ruptured my achilles heel, and because I had had no corrective surgery, that should have been performed shortly after the accident, it has started to heal on its own, the wrong way! So, what did they do! Sent me to therapy! As if THAT was going to cure it! While in therapy, it became obvious, I had not only ruptured the heel, but also damaged my hip when I fell! Being bed ridden all this time, it didn't show up until these guys actually had me walking on two feet! But all this is insignificant comparing it to your mother's death. I am sure these doctors and hospitals had the means to detect the presence of hini back in November. It's not like your Mom was the first person to die of it. They could have run the test, and perhaps saved her life.

You're rant is way to long with huge amounts of details ignored. You're also describing everything from your own point of view which means that there are lots of things you probably don't know or understand.

Your sister infected your mother with H1N1, not the hospital. They treated her as they could as more information came up. They didn't ignore her problems and there is no malpractice.
