Its my friend, and his plate was supposed to be PERMANANT and is already coming out. 2 or 3 screws are already loosee and he is in alot of pain and he has to have it removed and another surgery. and when He went to the doctor the doctor looked kind of afraid.

Yes it is, and if he's planning on suing, he should not have the same doctor do the surgery. Tell him to consult an attorney specializing in Medical Malpractice.

Good luck with that malpractice thing. In order to sue a doctor for malpractice you have to find another independent doctor to testify on your behalf.

Like I said, good luck with that. It's very rare for a doctor testify against one their own.

The above posters are both correct. It is malpractice, but it's also difficult to get one doctor to testify against another. That's probably why the first poster suggested that another doctor do the surgery. Doctor #2 becomes the witness against Dr. #1.
