I'm getting ready to take my ex-husband to court after 6 years of not having to pay ANY child support. We've gone before & he has always claimed to he's not working & can't affort to pay child support.The judge always take pitty on him & I get screwed over. He is on disability & get at least $ 1,700 a month for the, plus he gets money from the V.A from when he was in the Army & he suffered an injury. But it's not like he has any bills, I know that in 2005 he won this HUGE medical malpractice law suit. With the money he bought a farm with 20 acres & another 10 across the road from there. He has farm equipment. bulldozers, backhoes, semi truck, trailers, & much more. He pays cash for everything, I just need to prove it to the judge so that when we go to court it's not my word agianst his. Personally I don't care what he has or owns but after 6 years I'd really like him to have to do something for our kids.
I know that laws differ from one state to another so I just wanted to add that I live in Michigan.

court proceedings will track down what people own. your problem is if he hides it in other peoples name. I wish you luck

The State Department of Motor Vehicles should have a registration for every vehicle he has licensed to operate and as his ex-wife, you should have access to that information for proof in court. All it should take is an inquiry by his name and SSAN at the nearest DMV.

I'm sorry to hear about your situation. I know how frustrating it get's my ex does the same thing. Here's the thing that sucks about it. In most states if someone is on disability the state has a set amount of child support, and unfortantaly judges do take pity on these people. My ex tried to get disabilty just because of that factor, he was mad because he was denied. The other thing is that he does not have to claim his law suit as income, because it was a personal injury. You can definatly get child support off the disability checks. Stick to it. It gets really frustrating, but in the end he will have to pay.

I'm hoping you have an attorney to assist you in this. They can hire a private investigator to track down your ex husband's hidden assets or maybe even a forensic accountant. You may be able to ask the court to have your ex pay for their services. It would be interesting to find out if he reported any of his income on his tax returns.

Michigan's laws are not that much different than Indiana's when it comes to child support. I only recently moved here to Alabama, but was raised and spent my life near you. The state can track down anything of real value owned by your ex. However, if he has placed all of this property into someone elses name, it will be harder. By now, your ex has reached the amount of back child support thats a jailable offense. There are two things in which you will need, but only one is by your choice. First you will need an attorney. I hate to say that as you will more than likely have to pay for him/her. Let this attorney run down the property and articles owned by the ex and also let him be the one to present it to the court. Being presented by an attorney seems to go farther with the judge in issues such as this. If an attorney is not an option, then at least talk to the child support division prosecuter and see if he will present it. Dissabled or not, your ex should know that he is going to jail if he doesn't pay. This leads me to #2 of what you need. You need a judge with nuts. If no satisfaction is granted, then keep going back. Every week if you have to. Sooner or later the law will be on your side if for no other reason than to get you out of the offices. It's a shame. But you know, that there are allot of women dealing with deadbeats such as your ex. Good luck.
