Because the insurance companies contribute a tremendous amount to Republicans. They are the ones that have to pay up. This is why they want health care reform killed. It is money that lines their campaign coffers.

Because "pain and suffering" is so subjective in nature. I have absolutely no problem recouping the actual cost of treatment, or of lost wages due to an injury, etc...but "pain and suffering" is just a way for a jury of unemployed trailer trash to "stick it to a rich doctor" or some other populist BS.
