I had back surgery in December to repair a severely herniated disk in my back. After being cleared to work I began work as a receptionist for a Chiropractor, a seemingly good fit. Well a few weeks into my job the Dr. began giving me adjustments for discomfort I was having. I was not in pain at this point. Well after a series of about 5 adjustments at work and over the course of 2 weeks myback health crashed hard. I was unable to work anymore and still have not been able to return after several weeks. I am in constant pain now and have difficulty doing normal activities. In an email he even stated that he thought it would be "difficult" for me to return to work. What can I do? I was fine before and able to work and loved my job. I can't even work ANY job now, what action can I take?

If you were fine before, why did you have the back surgery and what did they physician who did the surgery say when you asked about having chiropractic adjustments? If you sought further treatment without consulting with the surgeon, you might have troubles explaining why someone else is to blame for your current condition, unfortunately. While your chiropractor may be titled "Dr", it's not the same as a medical doctor and if you did not disclose the fact that you had surgery prior to his adjustments, you're most likely out of luck. I believe that malpractice does not apply to chiropractors the same way it applies to physicians, and as far as a workers' (not workman's) comp claim, it would only happen if you injured yourself while on the job, doing your normal duties. Workers comp doesn't cover something you asked to have done.

I have heard your story many times, or a rendition of the like. Sometime this practice (chiropractic) is not a good match for everyone in every situation. I also would have to ask if the doctor did some adjustments as a favor so to speak or did he charge you or your insurance, this also could hold some weight. I have also heard of a Chiropractor in our community who got sued many years ago for breaking a mans neck...so, it is not impossible to try and sue this doctor, but there may be many things to consider...consult free legal aid or a lawyer..........
