I was wondering if anyone thought that some of the malpractice suits that have been flying around everywhere are neccessary or just money hungry people that are over-exagerrating. If you have any experiences or know of people that have either juistified or un-justified cases. Thanks for letting me know :]

90% of all malpractice suites are directed at 5% of doctors . . . that being said . . . my dad's a doctor, my husband was a doctor, my grandfather's a doctor . . . all three have left medicine for corporate America because of money hungry jerks . . . it got to be like you were guilty just because you were a doctor . . . no one in my family has ever been found guilty . . . but we all pay for it just the same in insurance . . . my Dad left medicine in the mid 1990's . . . his malpractice insurance was over 500k a year (cardiac surgeon) . . . and people wonder why the can't afford health insurance.

Frustrated and hurt
People should also be aware that over the period of time that insurance premiums rose so dramatically, the insurance companies were responding to their own terrible investment decisions which cost the companies billions of dollars. Much of that cost was passed on to doctors.
Plus, the standard of fault that must be proven by a plaintiff is considerably stricter than in a normal personal injury claim. The doctor must be shown to have deviated from the standard of care a doctor in the state would follow. In practice this means that a doctor would had to have done (or failed to have done) something that basically no doctor in the state would have. Granted, many cases are settled instead of going to trial where the doctor would likely prevail. This is most likely though the decision of the insurance company, not the doctor, since the insurance company is paying for defense counsel and legal bills will be significantly less if a case is settled instead of tried before a jury.
There are of course two sides to every story, but I think this is one side that is overlooked and lost in the controversy.
