My fiance was sentence about a week ago. He continues to ask me if I could get him a attorney/ lawyer to get him out. He does not qualify for work release or house arrest. I feel like there is no point. I am going to pay for a attorney/lawyer so he/she could tell me what I already know. Is there a type of attorney/lawyer that will be able to help me? Or should I give up...

He can appeal but if he's already sentenced and it's not a long sentence, he should just do the time because, yeah, if he's convicted already and there were no errors in the trying of his case he's gonna be convicted again anyway.

if he's been tried, found guilty and sentenced, no lawyer in the world can help him now.

If the sentence was in error or unjust, hiring an attorney for an appeal would make sense, especially if there was some new evidence that would change the case.

Hiring an attorney after the sentencing is like putting on your seat belt after a car crash. You can do it if it makes you feel better but there's really no point.

There is a type of lawyer who specializes in "post conviction relief". They focus on either getting the original conviction overturned, if the person is innocent or there were errors in the trial (including evidence that was wrongly submitted), or in getting the sentence overturned (if it was illegal or even just unfair compared to what similar offenders were getting).

These sorts of proceedings usually take place during appeals, and this sort of lawyer is known as an appellate lawyer. A good one will give you a free consultation, in which he will tell you if it's worth pursuing an appeal or not, and roughly how much it will cost.

Most criminal lawyers give the first appt for free.

If you talk to one, your BF will get the picture and you will feel you did all you could.

so what you are saying is that he did not have a lawyer when he was sentenced? doubt if a judge would have allowed that unless he was pleading GUILTY...then it is pointless
