my mother who is a heavy set elderly woman fell down in walmart and sustained considerable injuries to her knee
she slipped on some slippery gooey substance
her insurance is refusing to pay,(as they say walmart should)
walmart claims they are not responsible cos they are claiming they didny have enough time to clean up the mess
they didnt even have a caution cone up
the claims adjuster had advised my mother NOT to get a lawyer,as he told her that they WOULD be compensating her for her medical expenses
now he has changed his mind and basically told her to go !#@ herself!!
what are your thoughts?
and NO she is not a sue happy person,she was legitamatly injured and then insulted by these ''claim adjusters''

My lawyer got me $ 15,000 for falling in the parking lot of a grocery store. Sue the #$ @% out of those @#@$ $ #@$ . Walmart is one of those companies that is exporting American jobs, and killing our economy in order to maximize their profits. They are greedy ba#%%#.

if you can prove that the substance was on the floor for an unreasonable amount of time you do have a case. If not then you cannot prove that they had ample time to clean the mess up, and they could argue that the mess was created a few minutes before your mom fell, and they are not liable.

sounds like politics (unethical) i would say,mom needs to demand action she deserves/be very persistent! let these people know mom's not going away

Get a lawyer, you lawyer should align you with a Chiropractor. Any medical care that you are getting at this moment, should be charge to your current HCP; for they will be reimbursed. This is why your doctor is going to ask: is this from an accident? The hospital registration will give you a form. Keep that form, but don't bother to fill it out. Take the form to the lawyer. The lawyer will in tern submit a form to your insurance which they won't deny, because they will now be convident that they are not at risk to invest in your mother's care. You, should not be talking to Wal-Mart. In fact you all probably did damage to your case if you have given any statement all. Get a Liar, I meant a Lawyer, NOW! I imagine, from what you have told us, you have a good case--pending.
Another thing, I hope that individual left on a Gurney, and she has taken off at least two weeks off from her job. If they didn't, I hope they sought some sort of car shortly after the incident.
