recently something happened that a lot of you read about and i thank you for your responses. quickly, while i was in the hospital, a nosy, bitchy nurse gave the police my medical information to help prosecute my wife. she divulged the severity of my injuries; when just an hour before the police asked if i would sign a form releasing my med. records to help prosecute her. so, i never signed the form and she gave them info anyway. isn't this illegal? isn't medical supposed to be highly confidential?
and lori, if your out there, your a sweetheart and i'll be writing yopu soon.
thanks

Nowdays health providers are mandated to keep medical information confidential. Looks to me like you have reason for a lawsuit.

I think your wife has the right to kill herself if she wants to. She shouldn't be called a criminal for that.
However, keep in mind that it is NOT the doctor's fault. Please please please don't ruin a doctor's career for something s/he didn't do.
Now, this is not medical malpractice. At the most, this could be considered a violation of your HIPAA rights. This means that the nurse and/or the hospital are at fault. Not the doctor.

That is correct. You need to tell your attorney what happened so that he/she can have the records excluded from evidence.

It is legal for the nurse to give records to a law enforcement officer in connection with an investigation without your consent. This is allowed for in the HIPAA regulations.
