On tuesday my daughter went to get her shots. The nurse that gave her the shot was not her normal one. I remember looking at the needle and thinking that needle is huge for a small 4 month old leg. She pulled the leg and jabbed the needle in. My daughter scream uncontrollably. In my mind I thinking that big needle must of hurt her. So when we got home we notice her leg wouldnt staighten out. so we pull the leg down trying to even it with the first one. My husband woke me up 2oclock in the morning and said he think its broke. it look the same way that it look after we got home from her shots. we took her to the hospital and not one but 2 doctors said her leg was not broke. so we went home thinking everything was fine. Friday I notice that her leg was still swole so I decided to get a 3rd opinion and took her to her normal doctor. She did xrays and said it was definitely broke. Now they are trying to put it on me and my husband. When we explain about what their nurse did, they didnt want to hear it. When the investigation is over and we are found innocent can we sue the 2 lazy er doc who pulled and yanked legs and said it wasnt broke.

Yes, you should be able to sue.

You may be able to sue the hospital for the nurse breaking the leg if you can prove it was her that broke the leg, but you wouldn't have much of a case against the doctors. You'd have to prove the doctors could see it was broken and decided not to do anything about it. Sometimes doctors can misdiagnose things.

first: the whole shot experience, sounds like a normal thing to me and yeah, needles hurt.... now to pulling the leg. do you actually know how hard she pulled it? you would first have to prove that the leg was broken due to the actions of the nurse. if it was broken before and the nurse did not know of the conditions, then she is clearly not at fault. because she didnt know. this is going to be very hard to prove you may, or may not have a case.....


but im kind of confused by your question.... are you trying to blame the nurse that gave the shots or the er drs? there IS a possibility that with the ER drs that they could not tell it was broken or not.. did they do any xray? if so it may be possible that she moved..... i just dont see it possible that two er doctors would miss a broken leg.... and then miraculously your regular doctor says it is. why did you not go to your regular doctor first?
