I was in a Nursing Home for 3 months. Care was lacking, mistakes were made, wrong medications ordered and dispensed to me.
I was 89, lost 50 pounds, and dying in their care. My family took me in a year ago and brought me back to life. The nursing home is suing me for lack of payment. I asked for my medical records but they said "we will release them only to our lawyer". I can't find anything in HIPPA or the legal world that says this is OK. Thoughts?

Sounds odd I'd contact an attorney if the care was so poor and lacking as you state you should sue them.

If you are acting as your own attorney (a dumb idea) you could subpoena them otherwise if you have an attorney, let him do it.

first contact a lawyer who deals with cases like this elder care and abuse and sue the nursing home for neglect on thier part as far as get your records you have your lawyer supena your records. The only thing regarding your records with Hippa is you are entittled to a copy of the records
I personally would look into having the nursing home's lienease revoked and the state to investigate them for abuse and neglect.
I am so grateful that your family was alert to the fact of abuse and got you outof there As far as them suing you for lack of payment i wouldn't worry about once that the state is involved in a complain of neglect.
