Do any elements of negligence present them¬selves in the actions of Charles Schwab? TD Waterhouse? Which company might be at greater risk of a negligence lawsuit on behalf of its customers? Why?

There are elements of negligence in both instances. In my opinion, Schwab may be in greater risk of a negligence lawsuit.
