I had filed for disability and the attorney had asked me to go around and collect all of my medical records and this was ludicrous due to the fact that I have had open heart surgeries and in terrible health and also had no car.I have never had an attorney to ask me this before.Well,needless to say,in court the judge asked my attorney for my medical records and he told him that he did not have them but that he would get them to him.I have serious doubt that he ever did BUT never the less,after I was informed that I was denied I called my attorney repeatedly to ask him to file an appeal but he never did ever call me back.Not ever.This was several months ago and now I am going to another attorney but I just found out that I only had 60 days to file an appeal in so now the attorney really fuc*ed me.I don't think I can get any back pay that I would have been entitled to and I hold him responsible because he did not do his job like he should have.And now I am having to have another open heart surgery again and having major heart problems and cannot work at all and I have no way to live.What can I do ?!

Begin by filing a formal complaint with your state bar. If they censure or disipline him then you will have no problem finding representation to file suit against him.

Typically attorneys are hesitant about going after one of their own.

Just look in the yellow pages attorneys under "legal malepractice." Its a growing field and there are plenty of lawyers out there who will take your case if it has legal merit. After all, that is how they get paid.

The yellow pages. You may have heard there is an attorney glut. It shouldn't be hard to find one who takes legal malpractice cases. There was a time when it was difficult to find an attorney who would take a legal malpractice case, but that was a long time ago.

In response to the sub-issues:
Keep in mind, very often you are the only person who knows all of the doctors and hospitals you went to. You can not assume the doctor treating you know all the places you have received care. A certain level of cooperation by the client is usually necessary to obtain this information. An attorney who is not pestering you for information very well may simply not be getting this information. Actually, that detail makes me think he is a GOOD lawyer.

The appeal thing is bad. Do you know for certain if he ever did file the appeal?

First of all, nice to hear from you again Sunshine. I believe I answered a question for you in the past and you gave me best answer.

Allow me to express my condolences to you in reference to your recent battle with disability. They are never easy even with a competent lawyer let alone with a lazy back stabbing SOB out to take advantage of those who are unable to even defend themselves.

This man not only screwed you over thru the system but he betrayed your trust, destroyed your hope, and insulted you as a person. Lawyers like these need to be burned at the stake. So I will do my best to help point you in the right place.

#1 You can bring your lawyer up on civil charges for malpractice. You can sue HIM for all the fees you paid. INCLUDING THE RETAINER...

#2 You will NOT be able to appeal I don't think. So you can sue the lawyer for "damages" which you go for the big bucks. I mean, you gotta be taken care of. A heart condition is nothing to play with.

#3 You need to find out who this attorneys direct comeptition is. Goto his competition first. The enemy would love nothing more than to skunk his competition and brand him unfit for duty as an officer or the court.

I can not give you a precise name of any "Good" lawyers only sufice it to say that you will find most lawyers hesitant to face off against each other when one of them is in the hot seat. However, they do battle in court every day so then again, it may be easier than you think. Your best bet is to have your journel up to date and ready to present to your purposed lawyer. Treat him as if he/she were a judge. Prove your case to the lawyer and they are more lilely to take you on as a client.

There are attorneys that specialize in legal malpractice claims. Contact your state or county bar association for a referral. Also, keep in mind there are time limits for bringing suit, so you should start to look for an attorney ASAP.
