my friend is trying to sue winn dixie ( grocery store) for negligence because they told an employee to clean up a puddle of pop twice and she slipped in it. fell nothin was wrong with her she didnt even go to the hospital. but i dont think she should be able to sue and get money. she lazy and just wants a free hand out.
Actions have consequences
She can indeed sue, for the entire amount of her damages. Seems a waste of money to sue for $ 0, if you ask me.

It does sound as if Winn Dixie was negligent because they knew about the spill but had not cleaned it up. However, before your friend could receive compensation from Winn Dixie, she must show that she incurred a loss of some sort -- usually monetary, in the form of medical bills or lost wages. If she just thinks the "slip and fall" was her "lottery ticket" she is mistaken.
The only way she may get some money is if she finds an "ambulance chaser" of an attorney, who is willing to file suit against Winn Dixie, and they offer her money to settle out of court, just so they can avoid paying their attorneys. It's not right, but...

I'm not a lawyer, but I think she would have to show some proof that she was injured by slipping and falling as a direct result of the puddle not being cleaned up. Doctor reports and stuff like that. Also she probably would have had to file an accident report with the store itself.
