I live in the Bahamas I was staying at a hotel in miami on vacation and was bitten by a tick on my breast. It was very painful and became infected. I had to see doctor when I returned home from vacation no one at the hotel offered to pay for my medical bills and did not even bother to apolagize for it. This reined my vacation and left me with a naughty mark on my breast. No one even returned my calls? Do you think I have a case against this hotel and what type of lawyer do I need and will they be willing to only get payed if I win my case?

The hotel is not responsible for your medical bills. You could have gotten the tick from anywhere and will not be able to prove otherwise. The hotel has no responsibility and no reason to return your calls.

Ticks are usually caused when you are outside. Are you sure it is a tick vs a bedbug?

For the hotel to be responsible, you would have to prove that this tick happened at the hotel and most likely impossible, especially if outside, there are mosquito's, ticks, flys etc and how can they prevent anyone from being bitten? It just happens and could happen back home in the Bahamas.

The lawyer you are referring to is a personal injury lawyer that does cases by "contingency" meaning if he wins, both of you get paid from YOUR settlement or if he loses, both of you get nothing. I guarantee that if you called one up and asked them to take your case, they will most likely say no, since how can you prove that the hotel in some way caused this tick to bite you and caused you to see a doctor. Lawyers will take contingency cases ONLY when they expect they have a good chance of winning and if they see a loser case, wont consider it period, since they will be wasting their time.

Now if your doctor could validate that in fact you had bedbugs vs a tick, could be a possibility they would owe you.

generally there is NO such thing as an attorney who does NOT get paid if they do NOT win........
attorneys who work on a contingency basis do so for their "FEES" and they charge for ALL out of pocket expenses win or lose.....
expenses can include and are not limited to:
phone calls, travel, depositions, meals while traveling, lodging, copy fees, mediation expenses, court filing fees, fees for the service of notices, etcetera... etcetra...
if you retain legal counsel be very careful about the payment agreement and READ the small print.....
