I injured my shoulder(torn labrum and my Dr went against the MRI report ant operated on a different area of the shoulder. Turned out that he was wrong and the MRI report was correct. I had to get a second surgery and now of much more limited motion in the shoulder, I also now have arthritis and constant pain in the shoulder. I may even need another surgery and maybe a shoulder replacement. The Dr's insurance company is ready to settle but I need to come with some numbers first. Thanks for the help!

You need to go see a lawyer. I cannot stress this enough. Even just visit a legal office, have a consultation, explain your situation. I dont know how much a lawyer would charge for helping you out, but I can PROMISE you that the amount of extra money you're able to get out of this will make it more than worth it.

Lawyers who work in this field do this sort of thing every day, it's their job to be experts on it, and, if they're anything near decent, they are. So ask one of them, not random people on yahoo answers.

There are a million people in the world who just go for a settlement.

My brother was once upon a time going to attempt this (crushed hand) and asked the same question as you. I explained to him that having a lawyer and have him justify the numbers. That way the opposing companies would take it seriously. I explained to him that injuries such as his (and yours) turn into a lifelong thing.

They initially had offered him just medical expenses. I loaned him $ 1500 to have a lawyer show up with him and he got the medical expenses paid plus 180K on top of that.

Never accept a settlement until a lawyer has had a good go at it.
