as a result, i lost my child. they did not check me until i had been there for an hour. by that time i was at a 4 and there was nothing they could do about it. i had my baby 45 minutes later at 23 weeks and 1.5 pounds. she was alive when she was born.

I would defiantly talk to a lawyer about this. No one on here is going to be able to give you a reliable answer...plus in order to sue the hospital you're going to need a damn good lawyer. I'm so sorry for your loss.

yes i would think that is malpractice. i wish you the best of luck though. no woman should have to endore the pain of losing a child.

Contact an Attorney, sounds like Neglect, or Malpractice to me. But you need to hire a professional. There are going to be certain protocol to be followed, and alot of times, hospitals are very apt to "buy out of" a malpractice suit. This is not acceptable. I am so sorry about your baby.

you probably were dehydrated causing the early labor depending on what they were doing for you durring that hour it may be a mal-practice thing....talk to a laywer

I am so sorry for your loss. It definitely sounds like they should have been more proactive in your care. I know there are a variey of medications that they can give to stop labor. And if you were dehydrated, they should have given you IV fluids and hooked you up to a monitor for the baby and to see if you were contracting.

Before you start talking lawyers, you should get a copy of your medical records from the hospital. Just say that you have a new OB and they want the records. Things start "getting lost" once they hear malpractice. Also, write down a detailed account of what happened, who did and said what, names of any medications they gave you, medical professionals you interacted with, and a timeline with as many minute by minute events that you can think of.

All that being said, it is possible that they could not have stopped your labor, even if they had done everything right. But you definitely need to get some answers for your future babies and your state of mind.

Contact a lawyer for an initial consultation, but if he or she says there isn't enough for a case, believe them. Medical malpractice is so hard to prove and cases can drag on forever. In some ways, you may be better off focusing on getting better and finding ways to remember your baby outside of a legal context. If you do decide not to sue, definitely write a letter to the hospital and send copies to everyone from the nursing supervisor to the CEO of the hospital to make sure that they know they screwed up and to keep them on their toes for other moms and babies. You could also file a complaint with the state medical board, but once again, it is hard to make a case.
