I recently lost my baby boy. I was 4months pregant and bled for the whole pregancy and still am. Im being treated at a military hospital. Im trying to build a case to sue for malpractice. I was already pregant and didnt know it and they gave me the shot. Could this be a reason why I lost my baby?
brooklyn tull: thank you so much for shedding some light on this for me. its appreciated. i have no clue where to start and how much i would even sue for?? there is no price for my babys life I just dont want this to happen to others. Our military hospital here has many problems. thanks again!

That could probably be a cause of that. I'm so sorry to hear that.
There are many things will influence your case.
1) Was it your request or the doctor's suggestion to have the shot. If the doctor suggested it it makes your case stronger.
2) Were you on birth control prior to receiving the injection. If so the doctor would have reason to believe that you were not pregnant at the time of the injection. If you were not on birth control prior to the incident then your case is stronger.
3) Did he give you a pregnancy test before the shot. This is seemingly unrelated but bear with me. I'm currently on a medication that may cause birth defects. I'm a man so I don't have to worry about that - obviously. But the information packet included with the prescription explicitly states that you need a pregnancy test 2-4 weeks after starting effective birth control (obviously a pregnancy test is done prior to starting birth control). So therefore if the doctor didn't engage in the necessary due diligence to prevent wrongly administering the injection you have a case.
4) Has this injection been proven to cause miscarriage. If so then you have a case.
Update:
The depo shot is supposed to be administered during you period. If it was not that could be considered malpractice.
But from what I understand, determining an exact cause of miscarriage is a difficult thing. It's common enough where It could be claimed that anything could have caused it to happen.
My suggestion is to do some research on the shot. Talk to other OB-GYNs if you can and see what their opinions are. I'm not a doctor so I can't tell you for sure if that would have caused you to miscarry. Although to me it's pretty clear that it did.
Also request a copy of your medical records before your doctor is aware you're seeking compensation. Although he's legally obligated to provide them to you and it's illegal for him to alter them you never know. Malpractice is a serious charge and he or she will not want to loose the case. Who knows what someone would do in a situation like that.
I'm not sure how difficult it will to get those records from the VA. I hear you have to jump though hoops with them.
Information is your friend. Lawyers like to gather up as much of it as possible. One little tiny fact may change everything. The more information you have the easier it's going to be for you lawyer to do his or her job.
Once you're ready to take this to the next step, you'll want to contact you local Barr Association to find a lawyer that has experience with this sort of thing. Just do a quick web search, they'll pop right up.
Try to find an attorney that works on a contingency basis. That way there's no up-front costs or obligations if you don't win.
I really wish you luck. I know that this isn't what you want. You'd much rather not be thinking about this. But it's only right that you're compensated for any wrongdoing on your doctor's part.
