My wife fell in a entery way of a Wall-Mart store in December of
2005 on ice. The manager at the store was very helpful @ frist.
But than my wife had to go to a doctor because of the fall she messed her back up and her hip and ankel and so we sent the bill to Wall-Mart thinking that they would @ least cover her medical bills nothing more. And my wife missed work due to this fall. Wall-Mart claims that it was not there fault that my wife fell in the entry way of there store even though it was not salted.
And then there people became rude and just kept pushing the issuie as if it was my wifes fault. We have spoken with several laywers and they say we are pretty much screwed. So what kind of advice can anyone offer that could help us . We feel that since we tryed to work with Wall-Mart that my wife should be entitled to her doctor bills and meds and for her lost wages and for my lost wages and for her pain that Wall-Mart should pay.

I know from first hand experience that Wal Mart has a scorched earth policy when it comes to lawsuits. They do not pay unless a judge enters a judgment. Since they have not cooperated with you, find a personal injury lawyer who will take the case on a contingency and go after them. Good luck.

I truly feel for you. We unfortunately live in a society where money dictates who is right - even though the lawmakers swear up and down that justice is blind... it is not.

don't go the legal route. Usually walmart has a fairly long driveway leading up to the parking lot and store. Stand off their property, but well within the view of anyone driving up that road to go to walmart. Have a sign in huge letters saying your wife was injured because of walmart's negligence and they refuse to help you. if you thought they were rude before, try giving them bad publicity.

Your best answer will come from a lawyer, or lawyers in your area.

The laws vary from state to state in the US, so depending on where you live, you may have a case, or or may not. Generally speaking, if you live where there is a lot of snow and ice, a person has the responsiblity to be aware that dangers exist when the temperatures are arounding the freezing point and there is a chance of snow or ice on the ground. In other areas, like Las Vegas, where it never snows and it rarely gets cold enough to freeze, you may have a chance at prevailing in a lawsuit. There are many other factors that could come into play as well. Perhaps it was not Walmart's responsibility to salt the entry, maybe it was the property owner's (if different from Walmart) responsibility.

Slip and fall cases are generally difficult to pursue on behalf of victims because there is always the element of contributory negligence. In other words, your wife should have been more careful. I am not saying that it was entirely, or mostly her fault, but at least partially.

If you are unable to find alawyer in your area that is willing to take the case, your wife could, in theory, file a lawsuit "pro per." I would not recommend it, because, like you said, they have tons of lawyers, and they will fight really hard.

This may be one of those situations where you just have to accept that life is not fair.
