Is This Miscarriage Medical Malpractice?

I found out I was pregnant in the middle of May. So I schedualed an appointment to see a doctor for June 7th. I explained that I was RH negative and that I wanted to see a doctor sooner, but they wouldnt allow me to see anyone untill I was 9-10 weeks along. I had an ultrasound done on the 7th, and it only showed the gestational sac. Which means my pregnancy had stopped at 2-3 weeks. So I spoke with the doctor and she said its very likely that I will miscarry and would most likely need to get a D and C. She sent me for bloodwork that week every 48 hours for 3 days to get my HCG levels. Then I called to get my results that friday. She had a nurse call me back, and told me I needed to come in and get yet another ultrasound done. So I got that ultrasound done and the same thing, only a gestational sac. So I spoke with a nurse, and she said the doctor ordered another week of bloodwork every 48 hours M W F. The nurse told me to call on Wed to get my results from M and W, to see if the levels were rising or falling and to schedual a D and C with the doctor because I needed to get the sac out of my body, as it was apparent the pregnancy had stopped 7-8 weeks earlier. So I called on Wed like she said and was told that the doctor wanted me to get the bloodwork done on Friday still. So I did. Then I called that following Monday to get the results. No call back. So I called Wed to try to talk to the doctor again. I had started lightly bleeding that past Friday, and was beggining to get fevers and some painful cramping. The receptionist then told me the doctor left for vacation that past Friday and I would have to wait for hr to come back from vacation! She hadnt even refered me to anyone else before leaving! I explained that I was supposed to have a D and C done and that this was a serious matter. She transfered me to the nurse I hads spoken with before. She was shocked the doctor did not give me the D and C yet as it had been 3 weeks since confirmation that the pregnancy had stopped. So the nurse sent me for an ultrasound the next day (Thursday) at the hospital next door as this was a serious matter. She told me a D and C would be schedualed for the following day (Friday) if all came back the same on the ultrasound. Well, at the ultrasound on thursday I started bleeding more and the tech said she could see the Yolk sac now in the ultrasound that she could see the sac moving down. (This means your going to miscarry). So I go to a friends house as planned, and all of a sudden I start getting a high fever and severe cramping to the point I couldnt handle it. I was naucious and did not feel good at all. So I call the doctors office for medication, I knew at this point I was miscarrying right then. They prescribed Vicadin. So I went to pick it up and miscarried in the middle of walmart. I did some research and found that the doctor should not wait more than a week to have a D and C done in cases like this! I believe its malpractice because if she did the D and C within that week I would not have gone through that dramatic and painful experience. And on top of that its been 3 weeks since the miscarraige and the bleeding has not stopped and a second sac came out tonight. I have been calling the doctors office for 2 weeks now to try and schedual a visit to make sure everything is happening the way its supposed to as the bleeding is light then heavy the light then heavy. But they refuse to see me until the bleeding stops. I called a planned parenthood and they told me that I need to see a doctor because bleeding should not last much longer than a week, 12 days at most. Its now been close to 26 days of bleeding! The doctor also refuses to ut me on birth control until my period comes, but planned parenthood says I should have been put on it right away. I also found out that I will now have to have a D and C done to remove the rest of the tissue that is stuck inside me. If a D and C had been done when it was supposed to be, then I would not have to be dealing with this right now. Is this medical malpractice? It sure feels like it!

It most definitely sounds like malpractice, not only that but morally wrong to let a woman go this long without removing their dead child. Its horrible that you had to go through all of this, a miscarriage is an awful experience to go through with good support from your doctors, I'd hate to think how traumatizing it was for you. I don't know who you'd speak to, maybe start gathering all of your medical records (by law you can request copies of any of these from your doctors offices) and speak to someone about legal proceedings.
My condolences go out to you and your partner hun, you should not have had to deal with this at such a hard time in your life xx
