2005 and we were too distraught to think about filing I now have custody of him for medical neglect from his father.Can I go back and challenge that.Since his dad lied He gave me not one dime for his support during that time

I'm so sorry to hear about your daughter. As for the tax end of it, you would have to prove that he lived with you and not his parents (or with his parents if they didn't file and they lived with you also) and you provided over 50% of his (or their) living expenses (i.e. shelter, clothes, food, etc.) and if the parents were separated, that a court order was not in place designating one of the parents as the claimant for tax purposes. SInce it goes back to 2005, unless you are a meticulous book keeper and have kept ALL of your receipts for the last few years, the likely hood that they would accept yours over a biological parent is slim to none.
