Constitution does not protect foreigners trying to kill us. I would prefer the US 'torture' of placing panties on my head over al qaedas cutting off heads with dull knives.

Back then, we didn't HAVE to torture our enemies to gain information.

It's pretty clears what constitutes torture -- it's enacted into federal law (for decades) and defined in treaties we have ratified (which have the same effect as federal law).

The constitution only talks about "cruel and unusual punishment" for crimes -- which means that torture cannot be used as a sentence -- but only implies (because of Due Process concerns) that it shouldn't be used for anything else.

No -- the US should not condone torture -- if for no other reason, that it makes us just as bad as the people we claim to want to destroy.
