Probably would be severely more easy, less time consuming, less painful, and less expensive, to just get another dentist or oral surgeon to extract it. I don't think the "malpractice" lawyers have raided the dental industry yet, however, maybe your onto something.

I work for a dentist and you can hire a lawyer and sue- he will have to provide the records- x-ray and clinical notes of the care he gave you and your tooth.
You have probably signed paperwork that requires that the matter go to a mediator who will listen to both sides and determine if you have been treated fairly.
In my dental experience ( have worked for 4 dentists over 17 years in the same practice) the patient usually does not understand the amount of care given to his tooth.
The patient tends to blame the dentist for root canal failure, tooth split or breakage or nerve pain. All common, things that can happen once a tooth has been compromised by decay or trauma or neglect.
It is frustrating, I know, but if you could go back to when your teeth were new and brush more effectively, your problem would be solved. Sad to say, time travel has not been perfected, yet, so you can go back and talk to to dentist or move on to another dentist knowing that every dentist is not the same and you will find one that you like
And take responsibility for your mouth.
