Let's say that an ER physician puts into written notes a KNOWINGLY false statement about a patient, and these are notes that are routinely put into a network information system for the hospitals many regional clinics. Then, let's say that this patient (unaware of what's been put into notes) later visits other physicians in other offices, and these physicians peruse the notes prior to talking with the patient about current complaints. The patient's care is then compromised due to the subsequent doctors' biases, derived from the first doctor's notes. Has the first doctor defamed the patient? Is it medical malpractice? Neither? Both?
