Dean is a former physician, so he knows about skyrocketing medical malpractice insurance rates, and the role of the trial lawyers in fueling the "defensive medicine" approach among medical personnel who order too many tests and other sometimes unneeded procedures "just to be sure" and to protect themselves against litigation.

It's been documented many times that legal costs are less than 5% of insurance company costs.
That hardly justifies them doubling and tripling rates these past years.
Legal awards have been CAPPED at 250K in California for many years now, and it hasn't made their rates GO DOWN AT ALL!!! In fact they're still among the highest in the Country.

Regardless of what Howard Dean said, I think that the emphasis on tort reform is wrong. Tort reform disadvantages the victims of medical malpractice. The states that have instituted tort reform have also not demonstrated any lowering of health care costs. Sensible limits to jury awards can be imposed by the courts without resorting to the more drastic limits that tort reform has implemented, especially when people are grievously and irreversibly injured through pure carelessness or gross neglect of basic standards.
The insurance companies and many doctors are happier with tort reform though. Howard Dean is a doctor, by the way.
