I have a collection agency trying to collect on doctor's claims from some services I had in May 2006. When I called my Health care provider BCBS, they advised me that the majority of the claims were not submitted within thier filing limit (15 months). Only a few were paid because they were sumitted on time. They (BCBS) have provided me with all the claims and letters showing the reason for non-payment. Also BCBS stated because the doctor was "out of network" that they could not call them and just have them write off the claims because of the filing limit. BCBS said I have to make them stop and that I was not responsible for payment not made due their negligence. The defunk doctor's office actually tried re-submitting the claims again in January 2008 and obviously got denied payment again.
Now it gets even better, the clinic has been closed for almost two years! No way to contact them, no phone numbers, nothing! I called information and there is nothing on record for that name.
Top it off the collection agency is calling me at my work! They said its the only number they have for me so they have to call me here. I have asked them NOT to call my place of employment and they still do!
Do I need to get a lawyer?

Wow, you should contact your local attorney generals office and file a complaint. You need to send a registered letter in writing to the collection agency. I would not pursue an attorney at this point, as it will highly likely only cost you more than the medical debt itself. See what happens w/ th attorney general.

hey there.. Frustrating situation.. I work in collections and the majority of them are medical.. Unfortunately in this situation it will boil down to the patient is always responsible to make sure their bill is paid for, insurance billing problems happen and is up to the patient to follow up to make sure all claims are submitted and paid. I know that's not what you want to hear.. but that is what it will boil down to.. you can go to www.annualcreditreport.com to submit a dispute and you acn also post consumer statements on there that way if anyone pulls your credit they will see your side of the story.. as far as them calling you at work.. if you have told them not to call you there then they are not allowed to call you there, you could definately file a complaint with the BBB or atty general about that.. hope this helps
