I am seeing an Endocrinologist and i have been seeing them almost a year. I am an FTM Transsexual and they do not have any experience in treating Trans people.
When i went in, i had already previously seen an Endo who was very experienced in the Trans feild and i had my files transferred from that doctor to this doctor.
When i started out on my Medication the Doctor and i agreed to start off low and work to higher and higher dosages. So i started out on 50mg bi-weekly IM injection of testosterone. When i got my blood levels checked the Dr. said my levels were 572 and i could not up my dose to 75 which was the plan, and that i could NEVER move up. This was 9 months ago. Every appointment ive had i have tried to make the Dr. See that even though my levels were in "range" they were on the lower end of the spectrum and that not only was every ftm guy i had talked to (which was ALOT) on double or tripple my dose. But i myself with an experienced Dr. was on 350Mg more a month before. I also tried to explain that i was still menstruating and that i am not on enough medication otherwise that would have stopped. But she claimed moving me up would be "malpractice"
At my last app my levels were at 100 which is ALOT lower then 572. Since i was on injection it fluctuates. And i was already asking to switcher to a gel form at this app. Which would give me a much straighter level because its applied every day. Range is between 2-300 to 1100 so despite the fact i was below at that app the Dr. still didnt move me up and said i had to wait to see what my levels were now that im on the gel. Which is another 3 months.
so basically.
The Dr will not listen to me.
Has strung me along for a whole year.
I asked them to consult with my old Endo they said "they never called back"
I am still menstruating and basically gaining hardly ANY secondary male characteristics. Which is the etire reason i see this doc and the whole point of the medicine.
The period should have stopped between 6-9 months ago.
The dr never told me when to get my levels done in order to obtain a better level read.
To my knowledge the dr has not looked into how to treat a trans patient.
The lack of proper treatment has been emotionally and psychically damaging to me.
And the biggest one is i have heard a few people tell me that the fact that i have not been treated correctly and have been on too low a dose. (which i looked in books the dose is too low) But that it can cause harm to my body and actually hurt me.
I'm not saying i would sue this Dr. cuz im not that type of person. but they have not only wasted a year of my life and of my transition, but they are also supposedly jeopardizing my health.
So could i sue them for Malpractice or any other things?

The thing is i already know you "cant" compare but the truth is you can. Any medical treatment for any disease there is ALWAYS a standard low. If im treating patient x for disease y, i know according to studies that the lowest dose of medication should be z.
it is in a very common medical book that 100 mg a week should be the lowest to achieve goals and then can be lowered back down. Any trans endo will most likely tell you this
i am going to get a new Dr. but i am still not pleased this one wasted a year of my life and possibly put my health at risk.
And i would not be suing for hate crime or discrimination because im trans i am suing because i am not being treated correctly with meds.

Although, i already know i need a new Dr. that was not that point of this ? I am changing asap. The point is asking if i have means for a lawsuit.
And i got this dr. because i took what i could get in the beginning with my inssurance

All seriousness, this may not be the best forum to ask this sort of question. People here aren't probably legal or medical experts. I'm MTF, but haven't really had any medical problems with my transition, so I don't really know what to tell you.

It depends on the medical company's definition of malpractice. They might cover some things and not others, especially if the company sees it as an "honest mistake" or "misunderstanding" of something. So I would check their policies, and some medical institutions might not be as understanding of transitioning issues.

Sueing would be fruitless. We're a tiny minority subject to all kinds of discrimination. Who do you think the court is going to listen to you or the doctor? It's a lot easier to just get another doctor. How 'bout calling up the old doctor and asking them for a new prescription?
You can't compare your dose to anyone else's. Everybody is different.
It is better to judge by YOUR results and labwork. And judging from those you are right. The problem is this doctor doesn't know what they're doing.
edit: I am on your side. But the court isn't going to side with you. You're a layman with no medical training. It doesn't matter that you're right, the doctor will be seen as more credible. And as long as he didn't cause bodily harm or injury the court will not be inclined to step in. And finally, with rare exceptions the court system is just as prejudiced as the general public.
It's frustrating, but it is what it is.

Doesn't sound good. Definitely need to get another doctor if he's not listening to you. Have you contacted the medical review board in your state?

Why go through all of this trouble to be treated by a doctor that is not an expert or even slightly experienced in dealing with your medical needs.
Find a doctor that knows what they are doing and is experienced.

Forget trying to sue. I suggest just finding another Endo. that treats transsexual people
