Of course it's excessive unless he were Bill Gates or a CEO of a company with a huge yearly income. IN the end WE pay for these huge awards in the form of higher health care and insurance costs. Damages need to be tied to reality.

no because if indeed they did not give proper medical care it was thier fault the person died and no amount of money is too large a price for someones life. (are you saying that person that died wasnt work $ 40 million?)

I think that if the court awarded her this $ , the hospital or staff must have done something in negligence. I hope to think that the court did not just award this lady all of that money for nothing. However, 40,000,000 is extremely excessive. Just think of how many poor families we would be able to take care of with that $ $ . Our system is screwed up. We have to deal with it I guess. That or try to change it!???????

Yes because Doctors are not GODS... granted yes they are responsible for making sure you get the medical treatment you need, but how do they know until they run tests and such.. you can't just walk in and they know what exactly is wrong with you.. so sometimes tests and stuff take longer and it takes longer to find out what is wrong with you... If it is complete gross negligence such as cutting off the wrong leg or leaving a towel in you, that is a different story.. but people can't expect Doctors to be GODs.. just like the commercials I hear on tv about if something is wrong with your baby because Doctors didn't perform a timely C-Section.. again they don't know anything is wrong with the baby until they run tests.. they are not inside of you, they don't know... People die from Cancer daily... who knows if that man would have survived, not to mention you never really survive cancer..they put you in remission because cancer can always come back- That's why our Medical Insurance is so extremely high.. because people forget that just because they are Doctors doesn't mean they are GODS

no it`s not excessive.
we aren`t talking about a mechanic who does a crummy job of fixing your car, we are talking about doctors who charge excessive fees and then screwed up and KILLED someone.
