While looking at the numbers, I would have to agree that malpractice gets a lot over-inflated press, considering that it accounts for a fairly small percentage of overall health care costs.

without a doubt it would be B. Just think of how John Edwards got his start. He sued hospitals in Texas using junk science and won millions of dollars a year. But you dont see him giving any of the money back now that he has been proven to be wrong do you?

Insurance companies spend four times what Medicare does to administer their programs, 14% to 3%. But the insurance companies aren't just trying to make their programs better, they are using that money to deny claims, to delay payments, and to refuse coverage or drop coverage on anybody they can. Anyone who is happy with their current insurance either has one of the government programs or has never had a catastrophic illness.
Edit: Malpractice costs are estimated to be 5% to 9% of all medical costs, just a drop in the bucket compared to other costs.

Malpractice attorneys and government regulation (not listed) are the ones I blame. It's not just the cost of the lawsuits, it's the cost of the massive over-documentation and paperwork to prevent lawsuits, preventing doctors from doing their job - helping sick people.
People's expectations are also to blame. Everyone expect to have the best possible health care no matter what. That's an unreasonable expectation. I want wealthy people to be able to have better healthcare - because eventually once that's proven to work, it will be made less costly and available to everyone.

Actually citizens only win malpractice cases 5% of the time. HMO's and insurance co.s and drug companies are the reason are costs have spiraled out of control. Dr.s who work for clinics and hospitals who pay by procedure and not by straight salary are also to blame, they are more likely to recommend treatment that makes them more money.
