How to sue for malpractice? mock trial?

I don't know if any of you have read the book Frankenstein. I am doing a mock trial in which my client, the monster, is suing Victor Frankenstein for malpractice, negligence, and emotional distress. What would be some arguments for malpractice? I think the worst thing he did was abandon his creation but I don't think it falls under Medical Malpractice.

If you haven't read the book, Victor Frankenstein creates a superhuman being. This being was not what he expected so he abandoned the monster shortly after his "birth". The monster went out into the world and killed Victor's brother. Once Victor and his creation are reunited, Victor yells at him and calls him demon and all this nonsense. The "Demon" vows that he will kill all of Victor's family because Victor was mistreating him. Everyone dies, end of story.

I did mock trials too for my law class, love them. Um malpractice and negligence is not taking care of a living thing. Victor was negligent for not supporting the monster emotionally and financially. This led to the mosnster feeling emotionally distressed which will lead to long term side effects. You can make some bs up cuz this isnt a real life case but a made up one about frankenstein. I wish i could help u more but i havent read the book so im just writing from the mini summary u wrote
