I injured my ankle 2 1/2 yrs ago.was told it was just sprained but later turned out it was broke. Had to have surgury on it to remove all the pieces of bone floating around then afterwards my ankle seemed to get worse. I was told yesturday that I have nerve damage, and we are still trying to figure out what else is wrong.My doctor says that more than likely my nerve damage came from when I had surgury.My question is can I sue my doctor that did the surgury for medical malpractice, and negligence. Or nothing at all?

1. it depends on the state you live in and the statute of limitations in your start for medical negligence. In many states you will have 4 years to present your case.
2. do you have medical reports from the doctor who said it was only sprained? did you follow his medical advice and is there any possibility that it could have been broken after his diagnosis? Was the doctor who conducted the initial diagnoses also the same doctor who performed the surgery?
Its possible the statute of limitations has not expired and if you have adequate evidence you can bring a case against the doctor. It will be very costly and very difficult however, and the end results may not be as expected. I assume punitive damages and malpractice could be considered, expenses for attorney fees and court costs, loss of income are all possibilities, but expect a very long case. And expect the defense to counter sue if your case is unsuccessful. Most malpractice attorneys will begin the suit on a retainer, so check with a local lawyer for the best advice and most often for a free consultation as well.
