It depends. You have to proove a bunch of stuff to get money. I don't remember everything but there were 2 biggies
The medical person must have done something wrong
that something must have done harm to the patient
If you have those 2 covered I would talk to a lawyer that does medical suits

Hope and keep trying.Get a attorney that works on a contingency basis.I have tried 4 so far but had no luck so I will just keep trying.18 months I went to a Er,4 hours of tests and told I had a foot infection,they did not pick up a blocked artery in my calf.5 weeks later with the meds not reaching the infection I had gangrene.7 days in a coma and 4 ops later I am know a above the knee amputee.You get sympathy but it is help and justice we need.I was told by my foot Dr the first Hospital did not do the simple artery bypass which would have avoided any amputation because I did not have insurance.So they wanted someone else to pick up the bill.

I was told from a malpratice suit it is hard to do. In the end sometimes you pay more for the lawyer then what you get unless you find one who will take percentage. If he gave you paperwork saying he was wrong you do you have him right there but you need alot of proof actually I was going to take one to court when he put braces on my teeth when he shouldn't had he actually gave all my money back to shut me up I was going to take it further had lawyer all lined up but I already had 2 cases out there that was more important so I didn't and if I remember right you have 6 years to do it after matter but the sooner the better Best of Luck.

A wrong diagnosis is not malpractice. Mal practice is when a doctor or nurse etc. does not use reasonable diligence and his or her best judgment in the performance of the job they have been educated and trained for. A physician is not necessarily negligent because of an error in judgment or because his or her efforts prove unsuccessful. Mal practice occurs when an injury to the patient occurs due to the actions of the medical professional.
