Negligence and malpractice are two different things but there may be components of both as far as a lawsuit is concerned.
Malpractice is harmful activity that arises from treatment and less usually, as a result of failing to render appropriate treatment (more often deemed negligence by the courts but in severe cases, may be labeled as malpractice).
Negligence is a harmful outcome as the result of not rendering appropriate treatment.
Unfortunately, unless you are trained in one of the medical fields, you may not be able to identify what comprises malpractice and/or negligence. Often it's only after the outcome of either that you realize there is a problem. There are some cases where you may be able to determine this simply from common sense, for example, if you have a loved one in extended care and they develop bedsores and you've been around enough to know that they aren't being turned and positioned regularly, you may have grounds for a negligence suit.
Malpractice suites are generally leveled at an individual while negligence suits are most commonly leveled at institutions, such as hospitals/nursing homes.
