i happen to agree that putting a cap on malpractice suits could help lower cost.doctors might not order tests they feel are just done to keep the lawyers off their backs.it could lead to less law suits which would lead to lower cost for hospitals and doctors on their malpractice insurance which could be passed on to the consumer.but i guess a lawyer like obama would hate that because that's true reform and makes sense .what do you think?

Doctors ordering tests or procedures not based on need but concern over liability or increasing their income is the biggest waste of health care dollars, costing the system at least $ 210 billion a year, according to the report. The problem is called "defensive medicine."

"Sometimes the motivation is to avoid malpractice suits, or to make more money because they are compensated more for doing more," said Dr. Arthur Garson, provost of the University of Virginia and former dean of its medical school. "Many are also convinced that doing more tests is the right thing to do."

"But any money that is spent on a patient that doesn't improve the outcome is a waste," said Garson.

Some conservatives have suggested that capping malpractice awards would help solve the problem.

President Obama doesn't agree; instead, his reform proposal encourages doctors to practice "evidence-based" guidelines as a way to scale back on unnecessary tests.
old style did you read this?right now many doctors are doing expensive test not because they think they need to but to protect them selfs from lawyers .

imho, i think the focus of the bill is controlling medical companies, not doctors or patients. also, given the legal system, i think a cap would be a state-level concern, not a federal one, since you can't (afaik) sue someone in federal court.

Oh, so you want the government to come between me and my doctor. If my doctor deems a test necessary I don't want some politician telling him what he can't do. At least that's one of the wing-nuts straw man arguments when it fits their agenda. Otherwise when it does not you want your doctor to not run test to figure out what is wrong?????

The government has no business coming between me and my Dr. All this is is a power struggle. If you can control someones private life then you can control everything about them. The devil is in the details of this thing. You should never make a decision in a hurry. Or out of emotion. It leads to misfortune.
