A friend of mine has gotten in a sever accident and was taken to shock trauma. he does not have health insurance. not only was his shoes stolen but they sent him home with us with blood still dripping from the stitches in his head and legs. he was not given any pain medication all though he has a fractured neck and cannot move the whole left side of body. he was in such horrible pain at the hospital that he was throwing up on him self. they did not clean him up before they sent him home. also he was no able to use the restroom while he was there for 5 1/2 hours which caused him to urinate on him self. after he left we had taken him home where we noticed that his arm was broken.It was swollen about 3 times the size of his other arm, we rushed him to a different hospital. where they only called the first hospital to see if they had x-rayed it. the first hospital said they did and it wasn't broke. so they decided to not xray it and sent him home again. we have finally taken him to a third hospital where they did xray it an found it to be broken in three places. and found that he had internal bleeding. can he sue for malpractice?

The first hospital who took the x-ray, they breached the standard of care assuming the 1 of the 3 breaks was at least visible. The first hospital had a duty to realize the arm was broken in 3 different places, if they took an xray to confirm this, they have absolutely no excuse for not treating him.
You're not going to get rich of this case, but you may get a nice little settlement.
Call the 1st hospitals risk management (not human resources) department, explain how they breached the standard of care and ask for a remedy ($ $ $ ) otherwise you will seek council.

I'm no lawyer, but I personally think it sounds like you could sue. Talk to a lawyer, and they'll let you know.

If the arm is broken, I think that should be a case that the medical people were negligent. Ask a lawyer.
