my dads doctor who he has been going to for two years and has had several operations with has failed to manage to diagnose cancer and a large tumour in his stomach which now is too late to be treated
can he take a case out against the doctor and if so how much money is he likely to receive
my father has been complaining with having a lump in his stomach for the last two years he has been attending a top consultant in Ireland regularly and this consultant told him all the time that the lump is only torn muscle ,last year he operated on it and said he removed a hernia but a day after the op the lump was back and as sore as ever,the doc insulted him by saying go and join a gym and get excersize even though he is a fitness enthusiast and was a healthy weight . dad trusted this consultant and within the last few weeks he has become a lot worse ,he gets excruciating pain in the lump and in his private parts,and kidneys when he urinates ,he feels tired all the time and is losing weight rapidly ,so he went to see a new consultant today and he ran tests and reckons that the lump had been a tumour growing for the last few years at least and he told dad that the old consultant should of been able to tell it was a tumour and also said there was no way it was ever torn muscle or a he

what it comes down to is could the origonal doctor reasonably be expected to have detected the true cause of the problem. Were there tests which he was negligent in not undertaking? This is very difficult to prove and in court one doctor rarely stands up and denounces another. There are specialist no win no fee medical lawyers in the UK - I would suggest you look for the same thing in Ireland. Our laws are similar to yours and I would guess you will have the same legal companies as we do. Basically if they think you have a case, they will take it and either take a cut of the outcome or more commonly win fees in the case so the other party pays them too. If it is likely to prove fatal (and I hope not) the pay out would be based on the age and possible loss of income/ dependants etc. Good luck.
