I was having a gall bladder attack back in July of 2008 and as a result had several x-rays and ultimately my gall bladder removed.
In April of 2009, I was having some lower back pain and had X-Rays done.
Now in August of 2009 I was diagnosed with a large kidney stone. When I went to the urologist I was referred to, I was told to bring my x-rays and medical records from my initial diagnosis.
When I went to the medical records department, they asked me how far back did I need my films and reports and I told them to go back to July of 2008 when I had my gall bladder attack and subsequent removal.
Imagine my surprise when the Urologist looked at those films from July of 2008 as well as the films from April of 2009 and there was the kidney stone getting bigger and bigger as the three films progresses.
I understand that a radiologist has to review these films and got a bill from them to prove it.
Question is: Is there any liability or negligence on the radiologist who reviewed the films on the prior to occasions who missed the kidney stone. My current surgeon who discovered this stated that there is even some mention in one of the written reports about it but nothing was ever mentioned or told to me.
Who, if anyone, is responsible for this oversight or is it just my tough luck?
Thanks for your help.

I'm sorry to say, but I think it's your tough luck. You would SO get the run-around if you tried to pursue this, and I doubt an attorney would even take your case!
Your best bet is to call a medical attorney and ask them.
Good luck to you, and I hope you get well real soon. Be glad you had the chance to discover this! Your health is the most important thing. :)

Unfortunately it is your hard luck. But yes it is the fault of the radiologist also. He is the real culprit.
