Hospital overdoesed me after surgery- Can I sue?
Will I have a case? Here's what happened:
After having back surgery I went into the recovery the ventilator was removed. I started to wake up and they asked me if I was in pain. I was and the nurse gave me morphine. However the dose was too high and I went back unconscious and stopped breathing. I was then given Narcan (the antidote for opioid given to overdose patients) and was masked and they had to manually breath for me until I came back around. I now have scaring on my face from the breathing mask being held to my face so hard. And I spent a horrible night after surgery with my body not being able to adequately absorb pain medication due to the Narcan blocking it. I basically had to endure raw surgical pain.
Anyway, I know they didn't do it on purpose, but now I have scars on my face that I never could have anticipated when I went in for back surgery. Do I have a case for malpractice? Should I even bother consulting an attorney? What kind of reimbursement should I expect
if any?

Of course you should consult an attorney. Any answer that is not informed by a careful review of the medical records is worthless. It would also help to be able to see your scarred face. A night's worth of pain probably does not justify the high price of litigation, but permanent scarring could yield significant damages IF there was negligence.

There is no way to tell whether there was negligence without reviewing the medical records. Just giving you pain killer is not negligence. Doctors are not insurance companies.

The state you are in is important too. Some states have caps and restrictions on med mal claims.

Nobody can really answer this without a lot more details of the case. The 'scars' you speak of should not be permanent, and you can't sue for what 'could' have happened.

There is always a risk of overdose on any anesthesia situation, that's why they make you sign a waiver.

To me, it doesn't sound like this is something that should be sued over, but it's more useful to see a competent attorney (NOT an ambulance chaser) and see what he thinks.

Wow, insulting the people who try to help you--classy. You should at least make sure you have your facts right when you do that.

My guess is you have some marks that will go away soon. An even better guess is that the jury will think you are a whiny witch.

You can sue but I will bet it doesn't go anywhere. Morphine, along with a lot of other drugs, do not act the same in everybody. When I was on morphine, a little and I got pretty stupid pretty quick. The nurses that gave it to me remarked on it. The first time I had it, I was informed after the fact I told funny stories, sang and told jokes. Don't remember any of it.
