Since medical malpractice lawsuits take place in state courts, any tort reform should take place at the state level. Two things that would help is one, loser pays and two is to set a a special court made of people who clearly understand and know all aspects of malpractice lawsuits to review all malpratice lawsuit decisions.

That has already happened in some states. Texas passed malpractice reform several years ago. Never mind that the cost of medical care has risen 37% since then. Malpractice has always been controlled by the states. I believe that loser pays is a good reform, but since so few of them ever get to court, it wouldn't affect that much.
On the other hand, the people it does punish are those who should have won a suit but can't get anyone to represent them because of the $ 250,000 cap. Like my friend whose mother was killed by a nursing home.
