I am in the process of settling my Personal Injury Claim. It is a phantom vehicle uninsured motorist claim.

I have the issue of new money settled but feel that I am entitled to Hamm fees or 1/3 of special damages but the adjuster says that Hamm v. State Farm only applies to PIP and not Med coverage.

Is this true? I have researched as much as I can and can't find the language to make my argument.

Please help...
