Yesterday my Attorney filed a complaint on my behalf against an Emergency Room Doctor. Can someone give me an idea on how long it takes to be served?

Most states give at least 30 days to serve the complaint. You need to be patient. This is going to take months, even years, to resolve.

About a week at the most. They have 30 days to respond to the Complaint and the Summons expires after that time. They will serve either the doctor or his insurance carrier. You probably wont' hear anything until the month is up though. Defense teams take their time filing an Answer.

If you have more specific questions, please feel free to email me. I'm a malpractice defense intern until I pass the bar and I've worked in malpractice defense for almost 8 years now.

First of all, what kind of malpractice are you suing for? What was the procedure done that made you decide to file suit? I would assume that it would depend on how complicated the procedure was and how much research it will take.

What do you think? Answer below!
