I work as a CNA for a large nursing home corporation. About four months ago a resident fell on me and I injured myself. I filled out a inncident report immediately and it was turned into the office. The next day I told my supervisor that I was having severe back pain, and that I thought it might be related to the inncedent the day before. I was shrugged off. They never sought any medical treatment for me, and as the weeks went on the pain got worse. I ended up seeking medical help on my own and after several tests was diagnosed with a bulging disc in my lumbar region of spine. I was unable to get out of bed each morning without severe pain. I ended up in physical therapy and still am. My injury caused me to be tardy to work, and my job preformance wasn't as good. They ended up firing me a few days ago for being tardy to work, but this is not a uniformally used policy. I've filled out for unemployment, but they are going to fight it. What I want to know is do I have a lawsuit on my hands? Shouldn't they have sought medical attention for me after I filled out the incedent report? Am I allowed to ask for a copy of my termination papers and the injury report? Should I get a lawer?

you should have sought medical attention on your own. no one else knows how bad you hurt. that said, a lot of states have an industrial commission which you must go through first. contact a civil attorney before you do anything else and he can advise you. there are a multitude of variables that were not included in your story and you don't want to put your fate in the hands of an anonymous idiot of the airways (which i may well be one) so talk to the attorney!

I have to agree with Esther. Your story sounds mighty fishy to me too, but if you have the proof you need, then hire a lawyer and go for it.

Get a lawyer NOW ! that specializes in worker's compensation, most companies will fight tooth and nail over worker's Comp Claims, if you've been to the doctor, keep all the info, see a doctor to make a medical case, otherwise it's your word against theirs, unless you have witnesses.
