My Dad slipped and fell while on a client's iced-up driveway. He was carrying his toolbox and fell sideways on it, on his rib area. He didn't break anything, but he was lying out there for a while in the below-freezing temperatures (Canadian winters are scary), and his doctor said he had pneumonia. The doctor has already stated that the pneumonia he got is most likely directly linked to the bruising in his upper rib area (he explained the science of it, but I've forgotten it).
So the lawyer for the insurance company offered a mere $ 2,500. We made a counter-offer of $ 95,000 (since my Dad has a dabilitating cough, his lungs are damaged, even though this is happened 2 years ago).
So these are my questions:
1) If they accept our offer without going to court, how long will it take for them to payout?
2) If this goes to court, and we win, how long will it take for them to payout *then*?

There are WAYYYY too many variables in your question for anyone to even begin to give you an educated answer. There are no laws that say "You must be paid by XXX days!" It can take days or it can take years, or you may never see a cent!
MSAD
1. Your dad was walking on ice. A hazard that was there to be seen. Most likely the 2500 offer is a nuisance offer. That means they believe they have no liability for your dad's injury but are making a small offer so that you will go away.
You can counter offer 1.3 million. Does not mean your claim is worth anywhere near 1.3 million. Nor does it mean you will get 1.3
million.
If they have offered 2500...they will NOT pay 95K. They will NOT offer to pay anywhere near 95K.
2. There is no guarantee you will win in court. The jury can come back with a verdict of $ 0.00. Then the only thing you win is a legal bill to pay.
And with a slip and fall case...those can be very iffy. Your dad was doing the walking. Your dad was carrying the tool box. Most likely the ice was a hazard that was there to be seen. Usually ice is accompanied by snow and ice in other places. Usually you are on notice of the possibility of ice because of the surrounding weather conditions. Just because you fell on someones property .....does not mean you get paid for it. Sometimes cr@p happens and you don't get paid for it.
In my area, it can easily take 2 years from the time a suit is filed before a case ends up in trial.
I suggest you stop counting those chickens before they hatch. This is not a sure thing.

I can tell you from experience that an insurance company will take its s w e e t time paying out. I was injured in a car accident almost a year ago and my lawyers and the insurance company of the driver at fault still haven't settled. If it's been two years for you already, there is no telling how much longer it may be. And with our current economic state...oh, let's not even go there!
