I know this is a touchy subject with a lot of people but I believe I have a serious case. I need to know if I can sue the hospital for making my dad suffer for a whole night unnecessarily. Last night my dad got to his room in the hospital after having a dialysis treatment, which he was unable to complete because he started to feel bad. Later he kept complaining that he couldn't breath, and the nurse saw him and didn't do anything. Later he started crying and yelping and gasping for air and yet the nurse did nothing but check his vitals and found out everything was okay. We asked for a doctor one came and check him with his stethoscope and left, this occurred around midnight.

As time went on my dad kept yelping and crying and pleading for help, yet still no help, the nurse just assumed he was dying and did nothing. In the morning they found him unconscious we spent the whole night with him asking for help but they told us to wait until morning. Morning finally came and he was rushed to ICU, where he regained consciousness for a while and is currently on semi life support. He seems okay now, but would have been fine if they did something last night about his inability to breath, but they refused to because his vitals seemed okay.

This hospital seems to be treating my dad as if he were on hospice instead of in treatment like he is...

Is there a way to sue them for negligence or medical malpractice (the doctor did nothing in the last night when he should have called rapid response and have him in ICU so that he didn't have to suffer all the night, the nurse should have done the same thing but everyone just sat there and watched him cry for help). Once he gets better we will get him out of this hospital and to another for better treatment, we need to prevent this from happening again at this hospital, they treat everyone the same.

Hey!!! Money isn't the reason for this lawsuit... I need to save his life.... I need to make sure this doesn't happen again... this is NOT about money at all... this is due to the fact that this hospital keeps shoving hospice and death on people who want to fight for their lives.
Furthermore, the money if any comes from this would go entirely to help fix the problem they created and move to another hospital quickly, don't judge, people like you are not helping at all...
Furthermore, the problem is the doctors and nurses are working against my dad not for why should I work with them to try to save my dad when they are trying to kill them or their ignorance will.
Thanks Mary, this is exactly what will happen... however, my dad will be taken out of this hospital as soon as possible. I cannot let him stay there if they will not listen to him when he cries out for help. I have lost my trust of this place. As soon as he can go he will not return and will be going to a different hospital. P.S. I am following my dad's wishes and not my own.
Not sure if the location of the hospital makes a difference either, but yes it was in the United States. There are reasons why they did treat him bad but it was unnecessary, for one he had already been to that hospital for over a month and he had to return because he had breathing difficulties. He was discharged and they kept assuming they were going to discharge him every day so every day they make small plans to treat him and they didn't give him much help. However, it was at that day when his treatment was at the worst, ever, and it should never have been like that, he was crying for help and no one help him. He look straight at the nurses face with a gaping open I can't breath face and she did nothing. The pulmonary doctor who works which such issues should have known and done something like they did in the morning that day. Only they should have reacted before morning, he was supposedly only holding on to a shred of life when morning came, he came real close to dying.

Quite frankly, I suggest you worry about your dad's health right now. He's in the hospital, he's on semi life support, and you're thinking about filing lawsuits? Pathetic. Work with the doctors and nurses and wait until he's healthy again, and then start thinking about money. If you deal with the hospital with a lawsuit mentality, he's not going to get good treatment.

You really need to get rid of the "I'm gonna sue somebody" mentality at this point! Take care of your father first. If at some point there is reason to believe he was the victim of medical malpractice, there will be at least two whole years to file. In the meantime, if you act as though you are even thinking about suing, it will scare the stuffing out of all personnel in the hospital, and your father's care will suffer simply because they are skittish. (For that reason, all attorneys I know make it a very careful point NOT to let hospital personnel know they are attorneys when either they or a family member is a patient. Nervous people make more mistakes than when they are allowed simply to do their jobs without additional pressure.)

First, are you in the US, or another country? Not that it makes a difference, I'm just curious because I've never had bad treatment like that at a US hospital.

Second, did he at any point while at the hospital ever see his kidney specialist? I assume he has one if he's in the US; I was on dialysis and I had one, that I would think that's the doctor who absolutely should have seen him, not whichever hospital dr. was available who is not a kidney specialist. I know that the one time I went to the hospital (actually s couple of years after my transplant, and not when I was on dialysis, my kidney dr or one from the practice was there every day).

So I am baffled by the treatmemt he received - it certainly wasn't good treatment - but where was the kidney specialist? I don't know what to tell you about contacting a lawyer because I know nothing about that. But I'd definitely makes some complaints to whoever runs this hospital.

I agree that you should take care of your dad first and then worry as to whether or not to sue. However, medical malpractice is a very serious thing and you should def keep good records and make sure that your dad recieves the care he needs. What state are you in? (if it comes to this) Most medical malpractice lawyers will offer a free consult to see if you have a case. Get their opinion. I will offer the link of some great lawyers in FL.
