and that child dies as a result of them neglecting to seek medical care, should that parent(s) go to jail? If it was 'religious based', is that enough of an excuse to keep someone out of jail? If you were on a jury, what verdict would you render?

I would find the guilty of child neglect and indangering the welfare of a child.... I would put them away for a long time, I would tell someone right away if you know of something like that going on. No mater if it is religious or not that child needs medical attention. Don't let anyone tell you any different.

If a parent knows their child is fatally ill, and they do not take them to recieve emergency care, they are directly responsible for that child's death, and should be charged as such.

Heck, if my kid has the sniffles I ring his pediatrician... I can't imagine my kid being on the verge of death and not even considering going to the hospital, religion or not.

Its all based on how a reasonable person would act. If they weren't acting reasonably in the best interest of the child then yes they will mostly likely go to jail. Most like for involuntary manslaughter or manslaughter. And at the least neglect. And that parent should go to jail especially if the death was preventable and it can be determined by experts in the medical field that if the parents had acted at a certain point to seek medical treatment the life could have been saved or at least be given a chance at life. Some things can not be avoided, but if it could have be avoided and the parents didn't act its their fault. Religion is not a strong enough defense to keep the parents out of jail. And like I said most courts systems use the "reasonable person test"

Although I don't believe that a child should be refused any medical intervention that resulted in a child's death there are several issue to consider here. If you state that if a child dies due to parental decision to not seek medical care then there are a lot of scenarios that this could fall under.
What if a low income parent has a child with symptoms that seem to indicate nothing serious and they don't see a doctor because they can't afford to? The symptoms turn out to be something more serious and the child dies, does that parent deserve to serve time?
In most cases these issues can be black and white but unfortunately in something as complex as this, there are definate grey areas.

It would depend upon what accurate information those parents had when they made a decision not to get medical attention for their child. More often than we realize children and adults die for lack of medical intervention simply because they did not seem so sick at the time or the disease progressed rapidly. This happens to people who have nothing against medical care. So I would have to know what the parent knew and WHY they did not seek medical attention. Let's face if if a religious person's religion forbids medical care that is not going to be a problem if the child has a simple sniffle, for which other parents might rush their child to the doctor.
Short of so much other information how can I say I would send someone to jail based upon neglect.

It depends on what happened. For the most part a neglectful parent will be guilty, but every situation is different.

It's involuntary manslaughter, or at least neglect. I don't care what a person's religious beliefs are, if they cause a child to die, a person can't use that as an excuse for letting their child die.
