What would be the Process to suing my landlord? What would you have to do? Would a lawyer take a case like this? I live in a apartment building, there is only one way to get in and out of the apartment building. There used to be two post to hold on to. but one of them has been broken since August of 2006. The landlord come here all the time and dont fix it. He just leave it. Right now it is winter and there is alot of snow and ice at times, but it hard sometimes to walk up and down on these steps, and than one of the post missing, you dont have any support. If someone was to slip and fall , hurt there back or even broke a bone. Due to the negligance of the landlord. Could you sue him for pain and suffering and stuff? What would be the proper steps in filing a lawsuit? What are somethings I would need to prove my case and win? I live in New York

well first off, take a camera and a recorder and make sure u have evidence of all the things. It is no doubt the landlords responsiblity to keep everything fixed and in good shape. Check if your lease says anything about this. Its not important if it does or doesn't though. Go to the housing department and report this. Im not sure how things work in new york sense I live in CA but you will and need photo evidence of everything.

contact the zoning, or code enforcement unit. They will make the landlord fix it. If you are injured because of it, call an injury attorney, they will take your case for a percentage.

You sue a landlord the same way you sue anyone else. Landlords do have a duty of care, meaning they are required to maintain their properties to protect others from injury. By the sounds of it, your landlord could be found liable for negligence if someone was hurt due to the broken post. But it does not sound from your explanation like this has happened yet and you can't sue someone for negligence for an injury that hasn't yet occurred.
Your best bet is to call your landlord and ask them to fix this. If they do not respond, you should follow up with a written note/letter. If they do not fix it in a reaonable amount of time, your landlord can be reported to the local housing authority.

You have certain steps to take. Mostly, you should document yourself silly and submit letters to your landlord about things that need attention. Always be respectful. People sue constantly over lazy landlords who won't fix anything.
