what is medical negligence
by guano

In a case where someone is injured due to negligence what would the government do? Under the proposed government alternative to private health insurance would the government sue a negligent party for reimbursement of medical expenses incurred, or would they simply absorb all medical expenses?

For the 99th time, the plan still uses private insurance carriers. So, in regard to your question, everything remains the same.

The patient would sue the responsible physician or health facility - not the insurer. Same as always with private insurance.

Or, are you asking if the insurer would seize the award to reimburse for already covered reconstructive care? If you are asking about that, they probably would. That's what insurance companies do.

Have not had a chance to read all that has been proposed.

I however feel that some new Laws are in order to put a cap on
Medical Suit Awards.

Also there is a need to reduce the percentages Lawyers rake in.
What suffering are they enduring to claim 30 - 50% of what is being awarded ? That is outrages.
Who pays us who work in the medical field for suffering with our Patients ?

M.E. Nothing remains the same if the government passes this bill.

Several provisions in the bill are by design to end the private insurance industry. I suggest you READ THE BILL!!!
