I have a straight forward case of Dentist malpractice or Negligence!!
To make this awful experience short:
I went for a cleaning and whitening , while performing the cleaning the dentist discovered a small cavity, She offered to "take care of it", I agreed, to pay extra, ($ 600 for the cleaning & $ 100 for the cavity= $ 700) she performed half cleaning and gave me an appointment to finish the cleaning and to "take care of the small cavity". So i went to finish the dental work the following week, that time I realized that she was really young and with low experience in other words she was learning and I was her dummy. She finished everything and "took care of the cavity". Weeks following the work done in my teeth I started to feeling a whole lot of pain where she took care of the cavity, went back to her, she once again brutalized me by replacing the filling, again went back home, now with more intense 24/7 pain than before.
went to speak to the "specialist/owner" he apologized and drilled my mouth again, went back home for few days it was ok but again, I was fuc**ed with pain, went back with a lot of pain. At this point of time he realized that the Bit**h who did the cavity had screwed up my nerve so he ended up performing a "Root channel" on me $ giving my $ 700 cash back after I told him that I was going to see him in court... I'm pissed off because I had a perfect mouth before I went to that shitty place, and after I was screwed by an idiot.
The doctor acted highly unethical in many, demanding me to leave when I was in pain. I was terrorized and in pain so I felt fukd!!
I'll be taking him to small claims and will demand $ 7500.
what will happen? can you share your experience?
I'm not after the money but after justice and compensation for their malpractice and the pain I had to endure, without time I left from work, school I missed, gas, time, sugffering etc..

I believe you have an excellent case. The money returned to you is an obvious acception of quilt. Dentist too often get away with a lot of crap. I had one chip my front tooth while reaching in to do work on a back tooth.
I hope you get enough to buy a new caddie. It will probably make the dentist a better person.

You're a little late in the game to just be learning the rules!!!
Since you have filed it in small claims, you don't have to convince a jury, just the judge.
But you DO have to prove your .case
You need documented proof of "WHAT WAS DONE WHEN".
Be prepared with dates, and the exact procedures that were done on each date.
I hope you have a copy of your treatments records? !
And a statement of the charges from the dentist?

Where is your negligence?
In the course of treatment, it happens all the time that a simple filling leads to nerve pain and root canals. You will have to PROVE that she was negligent or careless. You will have to prove that she did something that was not normal in the removing of decay from a tooth and the filling of a tooth. Or did she not do something that she should have. Did she perform her duties to the standard of care? For instance, did she do the cavity preparation, or fill the tooth without isolating the tooth with a rubber dam? Did she use the wrong restorative material? Another question is did she provide you with adequate informed consent? That is did she tell you of possible complications? Did you discuss different treatment options or different restorative material choices?
She will try to defend what she did or did not do? She will just explain how, the cavity looked small from the outside, but once she got into it, she realized it was bigger or deeper than she had first thought. Or, how the X-ray did not show the full size of the cavity.
Happens all the time!
As for them demanding you leave, they will just say that you became loud and belligerent and that it was best if you left the office.

Many times a patient comes in with a cavity, which the dentist fixes. The cavity may be very close to the nerve/root. In this case EITHER the cavity will 'take', the nerve will not be involved and settle down, and no root canal will be needed.
BUT the majority of the time, the tooth does not settle down--the cavity did involve the root, and the pain level goes off the charts because a root canal is needed. The dentist has told me numerous times over the years. "Either this tooth will settle down by tonite, OR you will be in excruciating pain and will need root canal treatment".
This is not the dentist's fault--it is something that happens sometimes.
Root canals cost up to $ 1,000 and the tooth is then 'normally'capped for another $ 1,000.
